What is mediation?
Civil mediation is a voluntary method of dispute resolution, which may enable you to settle a civil disagreement without a court trial. Mediation is a cooperative process in which parties work together to find a solution instead of working against each other. Mediation normally leads to better relations between the parties and to resolutions that hold up. Mediation is very effective when the parties have a continuing relationship, like neighbors or business partners. Mediation also works well when emotions are getting in the way of a resolution. This is because mediation normally gives the parties a chance to vent their feelings and view the dispute from all perspectives. Mediation may not be a good idea when one party won’t discuss a resolution or when one party is in a weaker bargaining position.

Our primary mediator, Juan Gilliam, has successfully completed 40-hr training courses in both Mediated Settlement Conferences in North Carolina Superior Court and OSHR Employee Grievance Mediation Training. He has been certifed by the North Carolina Dispute Resolution Commission to mediate cases for North Carolina Superior Courts.
As a result of 20+ years at the executive level of financial organizations, we have encountered many of the scenarios faced in mediations, which gives us the understanding needed to be objective and unbiased in the practice of mediation.

What does a mediator do?
A mediator helps resolve disputes by working with both parties to reach a mutual agreement. The mediator facilitates the process, but you and the
other parties in the case make your own decisions about a resolution.
The mediator improves communication between the parties, helps to clarify facts, identifies legal issues, explores options and helps you to arrive at a mutually acceptable resolution.
How can mediation help me?
In mediation, the parties can fully express themselves, in a less formal process, by voicing their concerns and thoughts regarding the issues at hand. However, in a litigation suit, the attorneys do most of the talking, in most cases. Therefore, unless you take the witness stand during the legal proceeding, your voice will not be heard.
Generally, attorneys aren’t necessary during the mediation process, unlike a litigation proceeding where attorneys are usually in charge of the suit, thus charging exponential fees.
Mediation helps you avoid court, which can be time-consuming, intimidating and inconvenient; a mediation is easier to fit into the schedule of most people.
Another benefit that often goes overlooked is the fact that in mediation you have more power and control over the outcome, opposed to leaving the resolution up to a judge or jury, which can be more risky, in some cases.
Is mediation confidential?
Yes, mediation is confidential. Details shared during sessions aren't disclosed to anyone outside the process. Therefore, the public will not be made aware of transcripts, documents, or other records used during the mediation process.
Am I required to participate in mediation?
Yes and No. While some jurisdictions do require litigants to attempt resolution as a faster and less costly method to resolve a dispute, in general, mediation is a voluntary process.
You may also terminate mediation in process if you are not comfortable with this method of dispute resolution.
